Our relationship with our customers is primordial and it is crucial we are both aware of our rights and obligations. These comprehensive terms and conditions have been put together to ensure there are as few grey areas as possible. We can only strongly recommend that you take time to read through them, understand them and their implications as they go hand-in-hand with our complementing documentation. In these terms “we/us/our” means and “you” means the Client, whose details appear on any proposal. The “Contract” means the agreement between you and us based on a signed correspondence, indicating acceptance of the will carry out the work requested and agreed on under the following terms and conditions. These terms and conditions do not affect your statutory rights. If you have any uncertainties about these conditions as they might apply to you or your project, it is your responsibility to clarify the situation by contacting us before the project gets under way.

The information below complements the information available in the documentation provided to each client. will carry out work only where an agreement is provided either by email, mail or fax. An ‘order’ is deemed to be a written contract between and the client, this includes email agreements and paid monies. Generally the contract is made of the Quote and the payment of the initial deposit.

Smart Tourism Website product

The Smart Tourism Website product comes in 2 options: DIY or Populate it For Me.

  • DIY: The client is responsible to populate the content of the website themselves. They will be provided with a website template as well as an online instructions manual
  • Populate It For Me: The client is responsible to write and provide the content to in the required format. will populate the content of the website on behalf of the client. The client is responsible to write their own content.
  • Email: By default all smart tourism websites come with the Google Apps email program: We will recreate 5 of your email addresses. The standard Google Apps plan you will be put on is free of charge up to 10 email addresses. If  you wish to use more than 10 email addresses you will be required to upgrade to the next plan where each individual email address is charged on a per user per year basis by Google directly. If the client does not want to use Google Apps and use another system our hourly support fees apply to link to the chosen system


Smart Tourism Website DIY option:

Apart from the website, clients receive:

  • 5 email addresses setup with Google Apps
  • 1 year hosting
  • redirection of 10 pages of the same domain name
  • 1h training consultation with our coach
  • Unlimited access to our online training library
  • Creation of favicon (if design revisions are required they will be charged at $93.50 per hour)

Charged extra:

  • Image resizing
  • Population of extra pages

Smart Tourism Website Populate it for me option:

Apart from the website, clients receive:

  • Please refer to your milestones in the project portal called activeCollab. If you need to reschedule your dates please let us know through the project portal.


  • Payment: Please refer to your quote and invoice for payment terms and conditions. If payment is late we reserve the right to suspend any service until such time as payment is received in full (without prejudice to any other remedy available to us). A 10% surcharge per week will be charged to overdue accounts so we recommend you pay on time. reserves the right to take legal action to recover any debts. Please remember we are a small business and as such we cannot afford outstanding debts of any kind.
  • Cancellation: Refunds are paid at the discretion of
  • Hosting: the website comes with free hosting for one year. You will be invoiced in advance for the next years hosting at $280 + GST. If you have not paid your hosting invoice reserves the right to take your website offline until settlement of all outstanding sums due

Copyright and ownership
  • You grant permission to utilise logos and any other company identity for the purposes of creating the website. You agree to indemnify from any and all claims arising from your negligence or inability to obtain proper copyright permissions for all content supplied.
  • A one-line design credit linking to will appear on the main home page of your website in text format. The link will be designed to fit the overall design of the site. You agree that this link will remain in place for at least 12 months from the time of completion.
  • When supplying content to assumes you have the permission from the rightful owner to use any images or design elements you have provided to us for inclusion in your website.
  • You will retain ownership of copyright, trademarks and other intellectual property rights in materials that you provide to us for use in the design of your website.
  • Ownership of the Intellectual Property Rights of the website design, including front and back end programming and design, will remain with This means you are not allowed to replicate the website without’s consent.

Further changes

  • Once a client has been given access to the content management system of their website, cannot be held responsible for, nor is obligated to rectify, any changes to the website (including design, structure and content) performed by the client. If you require assistance to rectify your website, it will be quoted as new work at our hourly support rate.
  • No updates/upgrades are performed on the website unless the client decides to buy a support pack to do so.
  • is always available for our clients with assistance through our support packs available on either or
  • Support requests that take 4h or more to complete will be treated as a development project and pre-purchased support rates do not apply in this case.
  • is not responsible for establishing or troubleshooting your computer, internet connection or programs (such as Outlook, iPhone etc). This is the responsibility of your own individual. If you need to contact for such support.


  • The Website Warranty covers the workmanship and quality of the website, any defects found with the website (apart from any addition done by the client), technical problems that occur with the website prior to going live (apart from any addition done by the client).
  • Apart from the above and for technical errors and oversights, makes no warranties of any kind, whether express or implied, for the services it provides. also disclaims any warranty of merchantability or fitness for a particular purpose.
  • will not be responsible for any direct, indirect or consequential damages that may result from the use of its services, including loss of data resulting from delays, non-delivery or interruption in service.
  • You acknowledge and agree that cannot guarantee the absence of service interruptions caused by Acts of God or other circumstances beyond our control.

Indemnity and liability

  • All services may be used for lawful purposes only. You agree to indemnify and hold harmless from any claims resulting from your use of our service that damages you or any other party and from your breach of the terms of use.
  • Our total liability to you in contract or in tort arising in connection with this contract shall not exceed the total price paid by you. We shall have no liability for loss of profits, business, revenue, goodwill or anticipated savings or for any other indirect or consequential loss.

We reserve the right to suspend/cancel any/all service, including all domain names if:

  • You have any outstanding invoice or account
  • Your account is in dispute or dispute resolutions procedure, court order, judgement, findings or determination
  • You fail to comply with any provision in this agreement or those referenced in this agreement
  • There is evidence of fraudulent, illegal, defamatory, offensive activities, or any activity in breach of a third party’s rights
  • We deem your use of our services may jeopardize the operation of the service, or our suppliers
  • We deem any other reason as satisfactory to protect, our staff and/or our suppliers

If your account is cancelled under this agreement:

  • You must pay all outstanding charges to us immediately
  • We may revoke/terminate any license issued to or by you in relations to the services as of the date of cancellation
  • We may immediately delete all data held prior to cancellation
  • We may perform any action without notice

Standard charges

  • In the absence of agreed rates, any consulting work will be charged at our consulting rate of $130 per hour + GST. Support and development rate is charged at $85 per hour + GST.
  • If is required to source information from 3rd parties on your behalf, this time will be charged at our hourly support rate.
